1. Introduction and Scope
These Terms & Conditions (“Terms”) apply to your use of the public website, the public documentchecking interface, and any consumerfacing digital services provided by Noname (“Deltalyth”, “we”, “us”, “our”). By accessing or using the service, you agree to these Terms.
These Terms apply only to consumers within the meaning of Estonian law. If you use the service for business purposes, the B2B Terms & Conditions apply instead.
2. Eligibility
You may use the service only if:
- you are at least 18 years old, and
- you have legal capacity under Estonian law.
3. Description of the Service
Deltalyth provides:
- informational website content,
- a public document or image checker, and
- optional digital features that may be offered free of charge.
The public checker provides preliminary indicators only and does not replace professional judgment, legal review, or official verification processes.
Deltalyth may modify, suspend, or discontinue parts of the service where reasonably necessary for security, maintenance, legal compliance, or technical reasons.
4. Public Checker – Data Protection Role
For the public checker, Deltalyth acts as an independent data controller. This means we determine how uploaded files are processed for:
- providing the checker result,
- ensuring security,
- preventing abuse, and
- improving detection reliability where permitted by law.

5. User Responsibilities
You may only upload material that you have the right to submit. You remain responsible for:
- the legality of the content you upload,
- ensuring that personal data is shared lawfully, and
- avoiding harmful or abusive use of the service.
- You must not:
- upload unlawful or infringing content,
- attempt to bypass security controls,
- interfere with the service,
- misuse the checker for automated scraping or dataset creation.
6. Intellectual Property
All software, models, databases, trademarks, and site content belong to Deltalyth or its licensors. You receive a limited, nonexclusive, revocable right to use the service for personal, noncommercial purposes.
You may not copy, modify, reverseengineer, or redistribute service materials except where mandatory law permits.
7. Prices and Payments
The public checker is offered free of charge unless otherwise stated. If paid consumer services are introduced, you will be shown the full price including taxes before purchase.
8. Right of Withdrawal (Consumers)
Under Estonian and EU law, you have a 14day right of withdrawal for digital services unless:
- the service is fully performed before the withdrawal period ends, and
- you expressly consent to immediate performance and acknowledge loss of the right of withdrawal.
Instant documentchecking services typically fall under this exception.
9. Liability
Nothing in these Terms limits your mandatory consumer rights.
Deltalyth is liable for:
- damage caused intentionally or through gross negligence,
- damage to life, health, or safety,
- obligations that cannot be excluded under mandatory law.
For other cases, Deltalyth is liable only for foreseeable and direct damage arising from breach of contract.
We are not liable for:
- loss of profit,
- loss of business opportunity,
- indirect or consequential damage, unless mandatory law requires otherwise.
10. No Warranty
The public checker is provided “as is” and “as available”. We do not guarantee that:
- results are complete or errorfree,
- the service will be uninterrupted,
- the checker is suitable for official or legal verification.
11. Changes to the Terms
We may update these Terms to reflect legal, technical, or operational changes. If changes materially affect your rights, we will provide reasonable advance notice. Continued use after the effective date means you accept the updated Terms.

If we cannot resolve the issue, you may refer the dispute to: Tarbijavaidluste komisjon (Consumer Disputes Committee) via the Consumer Protection and Technical Regulatory Authority.
13. Governing Law
These Terms are governed by the laws of the Republic of Estonia. If you are a consumer residing in another EU country, you retain the benefit of mandatory protections in your country of residence.

1. Definitions
“Agreement” means these B2B Terms & Conditions. “Customer” means the business entity using the Service. “Service” means the website, public checker, paid analysis, reporting, workflow, API, or related business services provided by Deltalyth. “Public Checker” means the free or limited documentchecking interface available without a commercial contract. “Paid Services” means subscriptionbased, usagebased, or contractbased business services. “Data Protection Laws” means GDPR and applicable Estonian data protection legislation. “DPA” means the Data Processing Agreement forming part of this Agreement.
2. Scope and Hierarchy
These Terms govern all business use of the Service unless a separate written agreement is signed. If there is a conflict between documents, the order of precedence is:
- A signed commercial agreement
- The DPA
- These B2B Terms
- Documentation or policies referenced herein
3. Acceptance
By creating an account, using the API, submitting files, or accessing Paid Services, the Customer agrees to these Terms on behalf of its organization and confirms it has authority to bind that organization.
4. Service Description
Deltalyth provides:
- document and image analysis tools,
- frauddetection indicators,
- reporting and workflow features,
- storage and retrieval functionality,
- API integrations,
- enterprisegrade services.
Deltalyth may modify the Service where reasonably necessary for security, legal compliance, technical improvements, or provider changes.
5. Data Protection Roles
5.1 Public Checker (Controller Role)
For the Public Checker, Deltalyth acts as an independent data controller. Uploaded files may be processed for:
- generating results,
- ensuring security,
- preventing abuse,
- improving detection reliability where lawful.
5.2 Paid Services (Processor Role)
For Paid Services, the Customer is the data controller and Deltalyth is the data processor. The DPA governs this processing.
6. Customer Responsibilities
The Customer shall:
- ensure it has lawful rights to submit all content,
- comply with applicable laws,
- prevent unauthorized access to its accounts,
- avoid misuse of the Service, including:
- security breaches,
- scraping,
- reverse engineering (except where mandatory law permits),
- creating competing datasets,
- interfering with infrastructure.
The Customer is responsible for user accounts created under its organization.
7. Intellectual Property
All software, models, databases, and materials remain the exclusive property of Deltalyth or its licensors.
Deltalyth grants the Customer a nonexclusive, nontransferable, revocable license to use the Service for internal business purposes.
No ownership rights are transferred.
8. Fees and Payment
Fees are payable according to the order, invoice, or commercial agreement. Unless otherwise stated:
- invoices are due within 14 days,
- late payments may incur statutory interest under Estonian law,
- Deltalyth may suspend Paid Services for overdue amounts after reasonable notice.
The Customer is responsible for all taxes except taxes on Deltalyth’s net income.
9. Confidentiality
Each party must keep the other party’s confidential information secure and use it only for fulfilling this Agreement.
Confidentiality obligations survive termination.
10. Security
Deltalyth implements reasonable technical and organizational measures appropriate to the risk. No system can guarantee absolute security.
The Customer must implement appropriate internal security controls for its own environment.
11. Third-Party Providers
The Service may rely on third-party hosting, email, analytics, or infrastructure providers. Deltalyth is not liable for third-party failures beyond what cannot be excluded under mandatory law.
Subprocessors used for Paid Services are listed in the DPA.
12. Suspension
Deltalyth may suspend access immediately where reasonably necessary to:
- protect security,
- prevent abuse,
- comply with law,
- address material breach,
- manage excessive technical load.
Suspension will be limited to what is necessary and lifted once the issue is resolved.
13. Term and Termination
Either party may terminate Paid Services:
- for convenience with 30 days’ notice, or
- immediately for material breach not remedied within a reasonable period.
- Upon termination:
- Customer data will be returned or deleted according to the DPA,
- outstanding fees remain payable,
- confidentiality and IP protections survive.
14. Warranties
Deltalyth warrants that Paid Services will be provided with reasonable skill and care.
Deltalyth does not warrant that:
- results are errorfree,
- detection indicators are definitive,
- the Service will be uninterrupted.
The Customer acknowledges that detection results are decisionsupport tools, not legal or forensic conclusions.
15. Limitation of Liability
To the maximum extent permitted by law:
15.1 Exclusions
Deltalyth is not liable for:
- indirect or consequential loss,
- loss of profit, revenue, or business opportunity,
- loss of data (except where caused by breach of the DPA),
- reputational damage.
15.2 Cap
For Paid Services, Deltalyth’s total aggregate liability is limited to: the fees paid by the Customer in the 12 months preceding the event giving rise to the claim.
15.3 Mandatory Law
Nothing limits liability for:
- intentional misconduct,
- gross negligence,
- death or personal injury,
- obligations that cannot be excluded under Estonian law.
16. Changes to the Terms
Deltalyth may update these Terms to reflect legal, technical, or operational changes. Material changes will be notified in advance. Continued use after the effective date constitutes acceptance.
17. Governing Law and Jurisdiction
This Agreement is governed by the laws of the Republic of Estonia.
Any disputes shall be resolved by the Harju County Court (Harju Maakohus), unless mandatory law requires otherwise.
